1. Agreement and the service
These Terms of Service (the “Terms”) are an agreement between you and Yaman Jalal, operating as Refinar (“Refinar”, “we”, “us”, or “our”). They apply to your use of the Refinar website, application, APIs, and related services (the “Service”). By creating an account, connecting a repository, or using the Service, you agree to these Terms.
Refinar is an AI-assisted workspace for making controlled changes to software repositories. The Service may read code and project context you make available, generate proposed changes, apply low-risk refinements, and open pull requests for work that needs review.
2. Eligibility and your account
You must be legally able to enter into this agreement. If you use Refinar for a company or another organization, you represent that you have authority to bind that organization.
- Keep your account information accurate and current.
- Keep your credentials and connected accounts secure.
- Tell us promptly if you suspect unauthorized access or a security issue.
- You are responsible for activity that happens through your account and for ensuring that your use complies with applicable law.
3. Repositories, permissions, and ownership
You choose which repositories and third-party accounts to connect. You must have the rights and permissions needed to authorize that connection. Refinar uses those permissions to provide the Service, including reading relevant repository content, creating branches or commits, and opening pull requests where you request it.
You keep ownership of your repositories, code, prompts, attachments, and other material you submit (“Your Content”). You give Refinar a limited, non-exclusive license to host, copy, process, and display Your Content only as needed to operate, secure, support, and improve the Service. This license ends when the relevant content is deleted, except where we must retain it for legal, security, backup, or dispute-resolution reasons.
You are responsible for reviewing generated changes, testing them, and deciding whether to merge or deploy them. A pull request or suggested change is not a guarantee that the change is correct, secure, or suitable for production.
4. AI-assisted output and safeguards
Refinar uses automated systems and human review workflows to help produce changes. Automated output can be incomplete, inaccurate, or contain errors. You must maintain appropriate backups, access controls, tests, and review processes for your software.
Our risk controls are designed to route higher-impact changes for review, but they are not a substitute for your own engineering, security, legal, or operational judgment. We do not promise that a change will be safe, uninterrupted, or free from defects.
5. Paid plans, billing, and taxes
Paid features, prices, included usage, and billing frequency are shown at checkout or in your account before you purchase. Unless the checkout states otherwise, a subscription renews automatically at the end of each billing period until you cancel it.
If checkout is provided by a third-party merchant of record, that provider may be the legal seller shown on your receipt and may apply its buyer terms, privacy policy, tax rules, and payment procedures. Refinar remains responsible for providing the Service described at checkout.
You authorize the applicable payment provider to charge the selected payment method for the purchase, renewals, applicable taxes, and other amounts shown at checkout. You are responsible for taxes on your own income or business activity unless applicable law provides otherwise.
6. Cancellation, refunds, and disputes
You can cancel a subscription from the available account controls or by contacting yaman@refinar.ai. Unless checkout or applicable law says otherwise, cancellation takes effect at the end of the current paid period and does not refund time already billed.
Refund requests are handled under our Refund policy. You keep any non-waivable consumer rights and any chargeback rights provided by your card issuer or applicable law.
7. Acceptable use
You may not use the Service to violate law or another person’s rights, interfere with the Service, bypass security controls, abuse third-party APIs, or submit content you do not have the right to process. Our detailed rules are in the Acceptable use policy.
8. Confidentiality and privacy
We will use reasonable measures to protect non-public information you provide. You should not submit secrets, credentials, regulated data, or other sensitive information unless the Service is intended for that data and you have a lawful basis to do so.
Our Privacy policy explains how we collect, use, share, and retain personal information.
9. Third-party services
The Service can connect to providers such as GitHub, cloud hosting, authentication, AI model, and payment services. Those providers have their own terms and policies. We are not responsible for third-party services, their availability, or changes they make to their APIs or permissions.
10. Suspension and termination
You may stop using the Service at any time. We may suspend or end access if you materially breach these Terms, create a security or legal risk, fail to pay, misuse the Service, or if we must do so to comply with law or a payment provider’s requirements. Where practical, we will provide notice and an opportunity to resolve the issue.
When access ends, you remain responsible for amounts already owed. Provisions that should reasonably survive termination—including ownership, payment, disclaimers, limitations of liability, and dispute terms—will continue to apply.
11. Disclaimers and limits of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the maximum extent permitted by law, Refinar will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. Our total liability for claims relating to the Service will not exceed the amount you paid to Refinar for the Service during the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot legally be limited.
12. Changes and contact
We may update these Terms as the Service changes or as required by law. We will post the updated version and change the date above. If a change materially affects your rights, we will provide reasonable notice where required.
